Delaware State Police arrested the owner of Apollo Entertainment Jan. 10, after state detectives returned him from New Jersey where he had been incarcerated.
David C. Mallozzi, 58, of Millsboro, was charged with two counts of issuing a bad check and two counts of theft by false pretense.
During the spring and summer of 2004, Mallozzi promoted a series of concerts to be held at the Georgetown Speedway during the summer of 2004. Mallozzi had leased the Speedway and sold advance tickets to the concerts. After holding only a few concerts, Mallozzi apparently did not make the money he thought he would due to poor attendance. Mallozzi, as a result of financial difficulties, had to cancel the remaining concerts.
On May 28, 2004, Mallozzi issued a check in the amount of $10,000 to the owner of the Speedway, in exchange for goods and services. Upon deposit to the victim’s bank, the check was returned because the account it was written on had been closed.
On August 13, 2004, Mallozzi issued a check in the amount of $402 to a 49-year-old female as a partial repayment for a large ticket purchase. Upon deposit to the victim’s bank, the check was returned due to insufficient funds.
Mallozzi was committed to the Sussex Correctional Institution in default of $4,000 secured bond.
