Request Now Law

From Gov. Carper's Office ...

DOVER -- A loophole in the Delaware Victim's Bill of Rights law brought to light by a Millville resident has been closed.

Delaware Gov. Thomas R. Carper signed House Bill 17 to all the victims of crimes by juveniles to receive, upon request, information about the defendant's compliance or non-compliance with provisions of his or her criminal sentence.

Millville resident Margaret Peck brought to light a discrepancy in previous victim's rights legislation that only allowed such an exchange of information for adult defendants.

Peck, a victim of a crime by a juvenile, took her complaint to Attorney General Jane Brady, who then helped with the drafting of House Bill 17.

"This bill is important for victims, ensuring that they have access to pertinent information about their offender's compliance," said Gov. Carper. "We applaud Marge Peck for bringing this issue to the state's attention so future victims are not kept in the dark."

Sponsors of House Bill 17 included Sen. Margaret R. Henry (D-Wilmington East), Sen. Patricia M. Blevins (D-Elsmere), and Rep. Nancy H. Wagner (R-Dover).

"Victims deseve to be able to obtain answers to basic questions about the defendants in their cases," said Brady. "They have a right to know, for example, whether a defendant is no longer incarcerated or whether the defendant has begun to pay restitution."
